Welcome to Take the Trip. We Make It Simple. This website and service are owned and operated by Peaxa Digital LLC, doing business as Take the Trip. We Make It Simple. ("we," "us," or "our"). By purchasing a travel plan or using our website, you agree to these terms. We kept them simple because we know you have enough on your plate.

1. Our Service

We provide one personalized travel itinerary based on the details you give us through our intake form. You will receive your plan via email within 48 business hours after you complete the form.

2. Information Only and No Seller of Travel

We are not a travel agency, a concierge service, or a licensed insurer. We do not act as a Seller of Travel. We provide suggestions and decisions to help you enjoy your trip, but we do not book flights, hotels, or activities for you. You are responsible for all reservations and payments to third parties. Our plans are for informational purposes only. We do not guarantee the quality or safety of any third party service provider mentioned in your plan.

3. Service Interference and Force Majeure

We rely on the information you provide. If you enter an incorrect email address or fail to submit the intake form, we cannot deliver your plan. We are not liable for delays or failures caused by events outside our control, such as natural disasters, strikes, or safety issues at your destination. In these cases, we will contact you to discuss a resolution.

4. Refund Policy

Because our travel plans are digital products created specifically for you, all sales are final. We do not offer refunds once you have purchased the service. If you have a problem with your plan, email us at hello@takethetrip.com and we will do our best to make it right.

5. Assumption of Risk and Safety

Your safety is your responsibility. We recommend checking local laws, weather, and health requirements before you go. By using our service, you assume all risks associated with your travel. We are not liable for any injury, loss, or travel disruption that happens during your trip.

6. Disclaimer of Warranties

We provide our service on an as is and as available basis. We do not guarantee that our recommendations will meet your expectations or that the venues we suggest will be open or available during your trip.

7. Intellectual Property

Your travel plan is for your personal use only. You may not resell it, share it publicly, or use it for commercial purposes. All content on our website is owned by Peaxa Digital LLC and is protected by copyright and trademark laws.

8. Indemnification

You agree to protect and hold Peaxa Digital LLC harmless from any claims, losses, or costs that arise from your use of our service or your violation of these terms.

9. Limitation of Liability

To the maximum extent permitted by law, our total liability to you is limited to the amount you paid for your travel plan. We are not responsible for any indirect, special, or consequential damages.

10. Governing Law and Disputes

These terms are governed by the laws of the State of Indiana, United States. If we have a disagreement, you agree to try to resolve it with us through good faith communication first. If we cannot reach an agreement, any legal action must take place in the courts located in Marion County, Indiana.

11. Severability and Waiver

If any part of these terms is found to be invalid, the rest of the terms still apply. If we fail to enforce any part of these terms, it does not mean we are giving up our right to enforce them later.
